Terms of Service

These Terms of Service (“Terms”) govern your use of The Flame application and website (collectively, the “Service”) operated by The Flame (“we,” “our,” or “us”).

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

You must be at least 12 years of age to use The Flame. If you are under 18 years of age, you may only use the Service with the consent of a parent or legal guardian. By using the Service, you represent that you meet these requirements.

EU/EEA residents under the age of 16 must have verifiable parental consent before using the Service.

To access most features you must create an account with a valid email address and password. You are responsible for:

• Keeping your password confidential
• All activity that occurs under your account
• Notifying us immediately of any unauthorised access

We reserve the right to terminate or suspend accounts that violate these Terms, engage in fraudulent activity, or harm other users.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any law
• Attempt to gain unauthorised access to any part of the Service or its infrastructure
• Transmit viruses, malware, or other harmful code
• Scrape, crawl, or systematically extract data from the Service
• Use the Service to harass, threaten, or harm other users
• Impersonate another person or entity
• Attempt to circumvent rate limiting, authentication, or security measures

You retain full ownership of all journal entries, reflections, and other content you create within The Flame (“Your Content”). We do not claim any ownership rights over Your Content.

By using the Service, you grant us a limited, non-exclusive, royalty-free licence to store, process, and display Your Content solely for the purpose of providing the Service to you.

You may export all of Your Content at any time via Settings → Export Journal. You may permanently delete all of Your Content by deleting your account in Settings.

The Flame is a personal growth and reflection tool. It is not a medical device, mental health service, crisis service, or substitute for professional psychological, psychiatric, or medical care.

The Service, including its design, text, essays, word content, code, and trademarks, is owned by us and protected by copyright and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from the Service without our express written permission.

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We will make reasonable efforts to notify users of material changes to paid features or data deletion.

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, arising from your use of or inability to use the Service.

Our total liability to you for any claims arising from these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD $100.

You agree to indemnify, defend, and hold harmless The Flame and its officers, directors, employees, and agents from any claims, damages, losses, and costs (including reasonable legal fees) arising out of your use of the Service or violation of these Terms.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we are incorporated, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction, unless applicable law requires otherwise.

We may revise these Terms from time to time. When we do, we will update the “Last updated” date above. Continued use of the Service after a change constitutes acceptance of the revised Terms. For material changes, we will notify you by email with at least 14 days' notice.
